The main goal of this auction site is to provide a safe and convenient way for sellers to offer their merchandise, as well as a fun and exciting way for buyers to find Rock-n-Roll items at reasonable prices. The following describes the terms and conditions on which eRock offers you access to this site. Introduction eRock.net has been established to provide services to its registered users as set forth in the outline below. This outline is the official operating policy of eRock, and by registering, all participants have agreed to abide by this policy as it is presented. This policy is subject to modification without prior notice as deemed necessary by eRock administration to adhere to accepted practices as applied to or developed in conjunction with the operation of this site. Eligibility for Membership Our Services are available only to individuals who can form legally binding contracts under applicable law. Without limiting the forgoing, our services are not available to minors. If you do not qualify, please do not use our services. Description eRock is an on-line Internet auction site, providing services for both buyers and sellers of Rock-n-Roll memorabilia and collectibles. Registration In order to participate at eRock, users must first register. Registration is free and non-binding. All personal information is kept strictly confidential, except for e-mail addresses, which are part of the auction process here at eRock. Registration information will not be used for marketing or solicitation by eRock or third parties, and will be maintained in a secured database. Registration is subject to verification of the information provided by the registered user when deemed necessary by eRock's administration. Rights of the Bidder As a registered user on eRock, bidders have the right to submit valid bids on items for sale in the auction. Although the bidder cannot be forced to purchase items successfully bid on, note that failure to do so is not in keeping with the policies agreed to and its continued practice is grounds for loss of all rights to participate at this auction site. If up to three legitimate complaints (or -3 negative feedbacks) are filed against a bidder, they may be barred from the site. eRock reserves the right to revoke the privilege of participating for any reason. Please also note that in most states by basic definition of contract a bid is considered to be a binding contract and failure to comply could result in legal action by the parties involved. Bidding on items Only registered users of legal age may place a bid on items presented in this auction site. eRock.net is merely the listing agent and is not responsible for any merchandise presented in the auction itself, but are willing to try and help out when ever possible with problems that may arise. Placing bids Registered users may place a bid for an item by using the form provided at the bottom of a viewed auction listing in the item description page and under the Bidding Rules. The bidder must enter a valid bid amount and quantity of items bid on. To get a full understanding of the bidding process and the auction itself, you are expected to read the Buyers Guide completely before placing any bids. Retracting Bids Bidders may cancel a bid while previewing their bid, but once the bid is placed it cannot be canceled. To do so would be unfair to the seller and other bidders in the auction. Should you make a mistake you should immediately contact the seller of that auction and try to explain. Sellers are generally forgiving of honest mistakes and at that point could choose to close the auction or continue the auction, but there will be no bid retractions. Rights of the Seller As a registered user, sellers have the right to list rock-n-roll related items for sale in the auction site. eRock reserves the right to refuse any item for any reason. Although the seller cannot be forced to actually sell items to winning bidders, failure to do so is not in keeping with the policies agreed to and its continued practice is grounds for loss of rights to participate at this auction site. Limits of eRock.net eRock is only a listing agent. Our auction site acts as a venue for sellers to conduct auctions and for bidders to bid on seller's auctions. We are not involved in the actual transactions between the buyers and the sellers. As a result, we have no control over the quality, safety, or legitimacy of the items advertised, or the accuracy of the listings, the ability of the sellers to sell items, or the ability of the buyers to buy the items they bid on. We cannot and do not control whether or not sellers will complete the sales of items they offer or whether buyers will complete the purchase of items they have bid on. We have implemented a user feedback system to help you evaluate the kind of person your dealing with. We would encourage you to (e-mail) communicate directly with your trading partner to help with the evaluation of the person your dealing with. Limits to Bidders eRock cannot be held accountable for the actions of sellers, such as refusal to sell offered merchandise. It is the responsibility of the winning bidders to resolve such disputes with sellers. eRock is not responsible nor can we be held liable for the merchandise presented by its users. Please let eRock know if you feel fraud might be involved. Limits to Sellers eRock cannot be held accountable for actions of buyers, such as refusal to purchase. It is the responsibility of the sellers to collect any money for sold items from the winning bidders. But please let eRock know if you are having a hard time contacting the winning bidder. Disputes Should a dispute arise, eRock may act as mediator between the involved parties. Resolution of disputes is the full responsibility of the involved parties. Should it become necessary, in extreme cases, eRock may release contact information to said parties.
