 Auction Security

If you feel that another user of this site is behaving improperly then we may be able to investigate and take action (including suspension and reporting to the relevant authorities).

It is important to distinguish between those things that we will investigate and those things that we will not.

Things we will not investigate

The Seller is making unreasonable demands. Unreasonable demands may include things such as charging a large amount for shipping, insisting on waiting 21 days for checks to clear etc. We suggest that if you have any doubts, then you should contact the seller for clarification before bidding. If you are still not happy DO NOT BID.

The Seller took my money and has not sent me the goods / The goods were not as described / The goods were faulty. etc. If you live in the US you may be able to take the person(s) to small claims court. You can also file a formal complaint for mail fraud (you have paid but not received your merchandise) by contacting your local U.S. Post Office. Visit the U.S. Postal Inspection Service to locate the office nearest you. The National Fraud Information Center can also help with filing a fraud report.

The Seller will not sell me the goods even though I was the highest bidder. They won't even respond to my e-mail to give me an explanation. We cannot force anyone to honor their auctions. You should leave feedback to warn other users. If a seller gets excessive negative feedback (as judged by the site administrators) then they will be barred from using this site.

The winning bidder is being unreasonable. Being unreasonable may include insisting sellers take post-dated checks and ship the goods immediately, wanting goods shipped to multiple destinations at no extra charge, refusing to pay etc. We cannot force anyone to honor their bids. You should leave feedback to warn other users. If a buyer gets excessive negative feedback (as judged by the site administrators) then they will be barred from using the site. You can always offer the item to the next highest bidder(s) should you wish to.

I have had unfair negative feedback posted against me. You may have left negative feedback on someone who has then done the same to you. You may have withdrawn from an auction because of concerns over the seller and they left feedback etc. We do not edit the user profiles except in extreme cases that may be subject to legal action. If the feedback means you are at danger from being barred from the site you will be given a chance to explain your actions.

Many complaints simply result from poor communication. Many users do not check their e-mail every day (particularly on weekends). If possible try to speak on the phone.

Things eRock will investigate

If a user is found to be engaging in the practices set out below they face immediate suspension.

False contact information
We use a number of methods to try and ensure that users are who they say they are if we find out we have been given false information the user is suspended immediately.

Bid Rigging - Sellers
Although sellers cannot bid on their own items they may have set up aliases to do this and or they may have friends bidding for them.

Bid Rigging - Buyers
One buyer places a very low bid on an item followed by a second buyer with a very high bid. The second buyer then refuses to honor the bid in the hope that the seller is in a hurry to sell and will take the much lower first bid.

Feedback Rigging- Positive
Although users may not leave feedback on themselves they may attempt to boost their rating by using aliases or may have friends post positive comments.

Feedback Rigging - Negative
Attempting to lower the rating of other users by posting unfair negative feedback or getting friends to do the same.

Offering items to users who are bidding
Contacting bidders to offer them goods similar (or the same) to those that they are bidding on in an auction.

Offering Illegal material for sale
This includes pirated CDs, fake items etc.

Attempting to "hack" www.eRock.net
Trying to interfere with the normal operation of the site. If deemed appropriate legal action may be taken.

Using language of a racist, homophobic, sexist, profane, threatening or sexual in nature
Self explanatory

All complaints are dealt with on a case by case basis. This may include use of one of our "investigative users" who appear to be a normal registered user. If you feel a user is engaging in practices that we should investigate, then contact us.

Please note: we will not always be able to let you know the outcome of our investigations but we will treat all complaints seriously and in complete confidence.
